California Determines That Vinyl Roofing Containing DINP Is Safe

The California Office of Environmental Health Hazard Assessment (OEHHA) granted the safe use determination (SUD) request for vinyl roofing containing DINP this week.

This request was granted based on OEHHA’s assessment that exposure to DINP from vinyl roofing is well below the proposed DINP safe harbor level. This is the first SUD issued by OEHHA in 12 years.  Almost a year ago, the Chemical Fabrics and Film Association (CFFA) submitted the SUD request for specified vinyl roofing, which was granted in full.

This decision represents OEHHA’s best judgment that a Prop 65 cancer warning or reformulation is not required for the use of DINP in vinyl roofing.  It represents a real breakthrough in using meaningful exposure analysis to determine the safe use of Prop 65 chemicals in California products.

OEHHA will issue final decisions by the end of the 2015 on the pending SUD requests for DINP in vinyl flooring, a vinyl carpet tile product, and a vinyl fabric product.

Safe Use Determination (SUD)

Issued for diisonoyl phthalate (DINP) in single-ply polyvinyl roofing membrane products with a nominal finished thickness of between 1.016 to 2.438 mm, containing no more than 15% DINP and heated to surface temperatures up to and including 210 degrees Celsius during installation, pursuant to our authority under Title 27 of the Cal. Code of Regs., section 25204(h)(1).

Who is OEHHA?

The Office of Environmental Health Hazard Assessment (OEHHA) is the lead agency for the implementation of Proposition 65 . On April 17, 2015, OEHHA announced that it had received a request from the Chemical Fabrics & Film Association, Inc. (CFFA) for a Safe Use Determination (SUD) for the use of diisononyl phthalate (DINP) in certain polyvinyl chloride (PVC) roofing membrane products. CFFA is an international trade association representing manufacturers of polymer-based fabric and film products used in the building and construction, automotive, fashion and other industries. The request was made by CFFA pursuant to Title 27 of the California Code of Regulations, section 25204(b)(3) .
